DEWAN PERWAKILAN RAKYAT REPUBLIK INDONESIA. PRESIDEN REPUBLIK INDONESIA. Menetapkan : UNDANG-UNDANG TENTANG PENGHAPUSAN KEKERASAN DALAM RUMAH TANGGA. Dalam Undang-Undang ini yang dimaksud dengan: Kekerasan dalam Rumah Tangga adalah setiap perbuatan terhadap seseorang terutama perempuan, yang berakibat timbulnya kesengsaraan atau penderitaan secara fisik, seksual, psikologis, dan/atau penelantaran rumah tangga termasuk ancaman untuk melakukan perbuatan, pemaksaan, atau perampasan kemerdekaan secara melawan hukum dalam Iingkup rumah tangga. Penghapusan Kekerasan dalam Rumah Tangga adalah jaminan yang diberikan oleh negara untuk mencegah terjadinya kekerasan dalam rumah tangga, menindak pelaku kekerasan dalam rumah tangga, dan melindungi korban kekerasan dalam rumah tangga.
Korban adalah orang yang mengalami kekerasan dan/atau ancaman kekerasan dalam Iingkup rumah tangga. Perlindungan adalah segala upaya yang ditujukan untuk memberikan rasa aman kepada korban yang dilakukan oleh pihak keluarga, advokat, lembaga sosial, kepolisian, kejaksaan, pengadilan, atau pihak lainnya baik sementara maupun berdasarkan penetapan pengadilan. Perlindungan Sementara adalah perlindungan yang langsung diberikan oleh kepolisian dan/atau lembaga sosial atau pihak lain, sebelum dikeluarkannya penetapan perintah perlindungan dari pengadilan. Perintah Perlindungan adalah penetapan yang dikeluarkan oleh Pengadilan untuk memberikan perlindungan kepada korban. Menteri adalah menteri yang lingkup tugas dan tanggung jawabnya di bidang pemberdayaan perempuan. (1) Lingkup rumah tangga dalam Undang-Undang ini meliputi: suami, isteri, dan anak; orang-orang yang mempunyai hubungan keluarga dengan orang sebagaimana dimaksud ada huruf a karena hubungan darah, perkawinan, persusuan, pengasuhan, dan perwalian, yang menetap dalam rumah tangga; dan/atau. orang yang bekerja membantu rumah tangga dan menetap dalam rumah tangga tersebut. (2) Orang yang bekerja sebagaimana dimaksud huruf c dipandang sebagai anggota keluarga dalam jangka waktu selama berada dalam rumah tangga yang bersangkutan. ASAS DAN TUJ UAN. Penghapusan kekerasan dalam rumah tangga dilaksanakan berdasarkan asas: penghormatan hak asasi manusia; keadilan dan kesetaraan gender; Penghapusan kekerasan dalam rumah tangga bertujuan: mencegah segala bentuk kekerasan dalam rumah tangga; melindungi korban kekerasan dalam rumah tangga; menindak pelaku kekerasan dalam rumah tangga; dan.
memelihara keutuhan rumah tangga yang harmonis dan sejahtera. LARANGAN KEKERASAN DALAM RUMAH TANGGA. Setiap orang dilarang melakukan kekerasan dalam rumah tangga terhadap orang dalam Iingkup rumah tangganya, dengan cara: kekerasan seksual; atau. penelantaran rumah tangga. Kekerasan fisik sebagaimana dimaksud dalam Pasal 5 huruf a adalah perbuatan yang mengakibatkan rasa sakit, jatuh sakit, atau luka berat. Kekerasan psikis sebagaimana dimaksud dalam Pasal 5 huruf b adalah perbuatan yang mengakibatkan ketakutan, hilangnya rasa percaya diri, hilangnya kemampuan untuk bertindak, rasa tidak berdaya, dan/atau penderitaan psikis berat pada seseorang. Kekerasan seksual sebagaimana dimaksud dalam Pasal 5 huruf c meliputi: pemaksaan hubungan seksual yang dilakukan terhadap orang yang menetap dalam lingkup rumah tangga tersebut; pemaksaan hubungan seksual terhadap salah seorang dalam Iingkup rumah tangganya dengan orang lain untuk tujuan komersial dan/atau tujuan tertentu.
Setiap orang dilarang menelantarkan orang dalam Iingkup rumah tangganya, padahal menurut hukum yang berlaku baginya atau karena persetujuan atau perjanjian ia wajib memberikan kehidupan, perawatan, atau pemeliharaan kepada orang tersebut. Penelantaran sebagaimana dimaksud ayat (1) juga berlaku bagi setiap orang yang mengakibatkan ketergantungan ekonomi dengan cara membatasi dan/atau melarang untuk bekerja yang layak di dalam atau di luar rumah sehingga korban berada di bawah kendali orang tersebut. Korban berhak mendapatkan: perlindungan dari pihak keluarga, kepolisian, kejaksaan, pengadilan, advokat, lembaga sosial, atau pihak Iainnya baik sementara maupun berdasarkan penetapan perintah perlindungan dari pengadilan; pelayanan kesehatan sesuai dengan kebutuhan medis; penanganan secara khusus berkaitan dengan kerahasiaan korban; pendampingan oleh pekerja sosial dan bantuan hukum pada setiap tingkat proses pemeriksaan sesuai dengan ketentuan peraturan perundang-undangan; dan. pelayanan bimbingan rohani. KEWAJIBAN PEMERINTAH DAN MASYARAKAT. Pemerintah bertanggung jawab dalam upaya pencegahan kekerasan dalam rumah tangga. (1) Untuk melaksanakan ketentuan sebagaimana dimaksud dalam Pasal 11, pemerintah ; merumuskan kebijakan tentang penghapusan kekerasan dalam rumah tangga; menyelenggarakan komunikasi, informasi, dan edukasi tentang kekerasan dalam rumah tangga; menyelenggarakan sosialisasi dan advokasi tentang kekerasan dalam rumah tangga; dan. menyelenggarakan pendidikan dan pelatihan sensitif gender dan isu kekerasan dalam rumah tangga serta menetapkari standar dan akreditasi pelayanan yang sensitif gender. (2) Ketentuan sebagaimana dimaksud pada ayat (1) dilaksanakah oleh menteri. (3) Menteri dapat melakukan koordinasi dengan instansi terkait dalam melaksanakan ketentuan sebagaimana dimaksud pada ayat (2)
Untuk penyelenggaraan pelayanan terhadap korban, pemerintah dan pemerintah daerah sesuai dengan fungsi dan tugas masing-masing dapat mei kukan upaya: penyediaan ruang pelayanan khusus di kantor kepolisian; penyediaan aparat, tenaga kesehatan, pekerja sosial, dan pembimbing rohani; pembuatan dan pengembangan sistem dan mekanisme kerja sama program pelayanan yang melibatkan pihak yang mudah diakses oleh korban; dan. memberikan perlindungan bagi pendamping, saksi, keluarga, dan teman korban. Untuk menyelenggarakan upaya sebagaimana dimaksud dalam Pasal 13, pemerintah dan pemerintah daerah sesuai dengan fungsi dan tugas masing-masing, dapat melakukan kerja sama dengan masyarakat atau lembaga sosial Iainnya. Setiap orang yang mendengar, melihat, atau mengetahui terjadinya kekerasan dalam rumah tangga wajib melakukan upaya-upaya sesuai dengan batas kemampuannya untuk : mencegah berlangsungnya tindak pidana; memberikan perlindungan kepada korban; memberikan pertolongan darurat; dan. membantu proses pengajuan permohonan penetapan perlindungan.
Dalam waktu 1 x 24 (satu kali dua puluh empat) jam terhitung sejak mengetahui atau menerima laporan kekerasan dalam rumah tangga, kepolisian wajib segera memberikan perlindungan sementara pada korban. Perlindungan sementara sebagaimana dimaksud pada ayat (1) diberikan paling lama 7 (tujuh) hari sejak korban diterima atau ditangani. Dalam waktu 1 x 24 (satu kali dua puluh empat) jam terhitung sejak pemberian perlindungan sebagaimana dimaksud pada ayat (1), kepolisian wajib meminta surat penetapan perintah perlindungan dari pengadilan. Dalam memberikan perlindungan sementara, kepolisian dapat bekerja sama dengan tenaga kesehatan, pekerja sosial, relawan pendamping, dan/atau pembimbing rohani untuk mendampingi korban. Kepolisian wajib memberikan keterangan kepada korban tentang hak korban untuk mendapat pelayanan dan pendampingan. Kepolisian wajib segera melakukan penyelidikan setelah mengetahui atau menerima laporan tentang terjadinya kekerasan dalam rumah tangga. Kepolisian segera menyampaikan kepada korban tentang: identitas petugas untuk pengenalan kepada korban; kekerasan dalam rumah tangga adaiah kejahatan terhadap martabat kemanusiaan; dan. kewajiban kepolisian untuk melindungi korban. (1) Dalam memberikan pelayanan kesehatan kepada korban, tenaga kesehatan harus: memeriksa kesehatan korban sesuai dengan standar profesinya; membuat laporan tertulis hasil pemeriksaan terhadap korban dan visum et repertum atas permintaan penyidik kepolisian atau surat keterangan medis yang memiliki kekuatan hukum yang sama sebagai alat bukti. (2) Pelayanan kesehatan sebagaimana dimaksud pada ayat (1) dilakukan di sarana kesehatan milik pemerintah, pemerintah daerah, atau masyarakat. (1) Dalam memberikan pelayanan, pekerja sosial harus: melakukan konseling untuk menguatkan dan memberikan rasa aman bagi korban; memberikan informasi mengenai hak-hak korban untuk mendapatkan perlindungan dari kepolisian dan penetapan perintah perlindungan dari pengadilan; mengantarkan korban ke rumah aman atau tempat tinggal alternatif; dan.
melakukan koordinasi yang terpadu dalam memberikan layanan kepada korban dengan pihak kepolisian, dinas sosial, lembaga sosial yang dibutuhkan korban. (2) Pelayanan pekerja sosial sebagaimana dimaksud pada ayat (1) dilakukan di rumah aman milik pemerintah, pemerintah daerah, atau masyarakat. Dalam memberikan pelayanan, relawan pendamping dapat: menginformasikan kepada korban akan haknya untuk mendapatkan seorang atau beberapa orang pendamping; mendampingi korban di tingkat penyidikan, penuntutan atau tingkat pemeriksaan pengadilan dengan membimbing korban untuk secara objektif dan Iengkap memaparkan kekerasan dalam rumah tangga yang dialaminya; mendengarkan secara empati segala penuturan korban sehingga korban merasa aman didampingi oleh pendamping; dan. memberikan dengan aktif penguatan secara psikologis dan fisik kepada korban. Dalam memberikan pelayanan, pembimbing rohani harus memberikan penjelasan mengenai hak, kewajiban, dan memberikan penguatan iman dan taqwa kepada korban. Dalam hal memberikan perlindungan dan pelayanan, advokat wajib: memberikan konsultasi hukum yang mencakup informasi mengenai hak-hak korban dan proses peradilan; mendampingi korban di tingkat penyidikan, penuntutan, dan pemeriksaan dalam sidang pengadilan dan membantu korban untuk secara Iengkap memaparkan kekerasan dalam rumah tangga yang dialaminya; atau. melakukan koordinasi dengan sesama penegak hukum, relawan pendamping, dan pekerja sosial agar proses peradilan berjalan sebagaimana mestinya. (1) Korban berhak melaporkan secara Iangsung kekerasan dalam rumah tangga kepada kepolisian balk di tempat korban berada maupun di tempat kejadian perkara. (2) Korban dapat memberikan kuasa kepada keluarga atau orang lain untuk melaporkan kekerasan dalam rumah tangga kepada pihak kepolisian baik di tempat korban berada maupun di tempat kejadian perkara. Dalam hal korban adalah seorang anak, laporan dapat dilakukan oleh orang tua, wali, pengasuh, atau anak yang bersangkutan yang dilaksanakan sesuai dengan ketentuan peraturan perundang-undangan yang berlaku. Ketua pengadilan dalam tenggang waktu 7 (tujuh) hari sejak diterimanya permohonan wajib mengeluarkan surat penetapan yang berisi perintah perlindungan bagi korban clan anggota keluarga lain, kecuali ada alasan yang patut.
Permohonan untuk memperoleh surat perintah perlindungan dapat diajukan oleh: korban atau keluarga korban; relawan pendamping; atau. Permohonan perintah perlindungai disampaikan dalam bentuk lisan atau tulisan. Dalam hal permohonan diajukan secara lisan, panitera pengadilan negeri setempat wajib mencatat permohorian tersebut. Penangkapan sebagaimana dimaksud pada ayat (1) dapat dilanjutkan dengan penahanan yang disertai surat perintah penahanan dalam waktu 1 x 24 (satu kali dua puluh empat) jam.
